By downloading, installing, or using the Sol Card Games application ("App"), you agree to be bound by these Terms of Service and End-User License Agreement ("Terms" or "EULA"), which together with the Licence govern your use of the App. If you do not agree to these Terms, do not use the App. These Terms form a legally binding agreement between you and MidMightBit Games ("we", "us", or "our"), based in Melbourne, Victoria, Australia.
We may update these Terms from time to time. Continued use of the App after any update constitutes your acceptance of the revised Terms. The current version will always be available at https://aardappvark.github.io/solcardgames-legal/terms.html.
You must be at least 13 years of age to use the App. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the App you represent and warrant that you meet this age requirement.
Sol Card Games is an offline collection of ten classic card games for Android devices, optimised for the Solana Seeker. It includes Klondike Solitaire, Spider, FreeCell, Hearts, Spades, Euchre, Gin Rummy, Poker (Texas Hold'em), Cribbage, and War. Games are played solo or against computer-controlled (AI) opponents. The App also includes optional statistics, achievements, and a daily challenge, all stored locally on your device.
No real money, cryptocurrency, tokens, or items of any value are wagered, won, lost, purchased, or transacted in the App. All in-game chips, points, and scores are fictional, have no monetary value, cannot be redeemed or exchanged for anything of value, and exist solely to keep score. All opponents are AI-controlled; there is no multiplayer or online play. The optional wallet sign-in reads only your public key for display and never requests transactions, moves funds, or reads private keys, and nothing in the App constitutes financial, investment, legal, or tax advice.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects will be corrected or that the App will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MIDMIGHTBIT GAMES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
TO THE EXTENT ANY LIABILITY IS FOUND, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED AUD $10.00 (TEN AUSTRALIAN DOLLARS).
Some jurisdictions do not allow exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in full.
Nothing in these Terms is intended to exclude, restrict, or modify rights that you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other non-excludable statutory guarantee, warranty, or condition implied by Australian law. Where such non-excludable rights apply, our liability is limited to the extent permitted by law, which may include (at our option) resupplying or paying the cost of resupplying the relevant service.
You may not use the App if you are located in, a national or resident of, or acting on behalf of a person located in or a national of any jurisdiction subject to comprehensive economic sanctions, including but not limited to those administered by the United States Office of Foreign Assets Control (OFAC), the European Union, the United Nations, His Majesty's Treasury (OFSI), or the Australian Department of Foreign Affairs and Trade (DFAT). You agree to indemnify, defend, and hold harmless MidMightBit Games and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party right.
The App and all its content, features, and functionality — including but not limited to all animations, graphics, source code, user interface designs, and text — are owned by MidMightBit Games and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App without our express written permission. These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the Commonwealth of Australia, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
