This End-User License Agreement ("EULA" or "License Agreement") is a legal agreement between you ("the User", "you", "your") and ADappvark ("the Licensor", "we", "us", "our") for the use of the SolScripture mobile application ("the App" or "the Software").
By downloading, installing, copying, or otherwise using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.
Subject to the terms of this EULA, ADappvark grants you a limited, non-exclusive, non-transferable, revocable license to:
This license does not grant you any ownership interest in the App. All rights not expressly granted in this EULA are reserved by ADappvark.
SolScripture is proprietary software. The App is not open source and is not released under any open-source license. The source code, compiled binaries, and all associated assets are the exclusive property of ADappvark and are protected by copyright and intellectual property laws.
Under this license, you may not:
The Bible translations included in SolScripture (BSB, KJV, WEB, ASV) are in the public domain and are not subject to the proprietary restrictions of this license. You are free to read, quote, and share the Bible text content. However, the specific digital formatting, arrangement, and presentation of these texts within the App remain proprietary.
This license is void and unenforceable in the following sanctioned or restricted regions: Cuba, Iran, North Korea, Syria, Crimea (Ukraine), Donetsk (Ukraine), Luhansk (Ukraine), Russia, Belarus, Myanmar, Venezuela, Zimbabwe, South Sudan, Central African Republic, Democratic Republic of the Congo, Libya, and Somalia.
Users located in these regions are not granted any license to use the App and must not download, install, or access the Software.
The App and all copies thereof are proprietary to ADappvark and title thereto remains in ADappvark. All applicable rights to patents, copyrights, trademarks, trade secrets, and other intellectual property rights in the App belong exclusively to ADappvark. This EULA does not convey to you any interest in or to the App, but only a limited right of use revocable in accordance with the terms of this EULA.
The App may include third-party open-source libraries and components, each governed by their respective licenses (primarily Apache License 2.0 and MIT License). These third-party licenses apply solely to those specific components. The use of such components does not alter the proprietary nature of the SolScripture application as a whole.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. ADAPPVARK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
ADAPPVARK DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADAPPVARK BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADAPPVARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This EULA is effective until terminated. Your rights under this license will terminate automatically and without notice from ADappvark if you fail to comply with any term of this EULA. Additionally, ADappvark may terminate this license at any time, for any reason, with or without cause.
Upon termination, you must:
Sections 3, 4, 7, 9, 10, and 14 shall survive any termination of this EULA.
ADappvark may, at its sole discretion, release updates, patches, or new versions of the App. This EULA applies to all such updates unless a separate license agreement is provided. ADappvark is under no obligation to provide updates, maintenance, support, or technical assistance for the App.
You agree to comply with all applicable export laws and regulations, including Australian export controls and international sanctions regimes. You may not export or re-export the App to any country, entity, or person to which such export is restricted or prohibited.
This EULA shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts of New South Wales, Australia, and you consent to the personal jurisdiction and venue of such courts.
If any provision of this EULA is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.
This EULA, together with the Terms of Service, Privacy Policy, Disclaimer, and Sanctions Policy, constitutes the entire agreement between you and ADappvark with respect to the use of the App and supersedes all prior or contemporaneous agreements, communications, and proposals regarding the App.
