ADappvark makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, timeliness, or availability of any information displayed in SolHerd. Any reliance you place on such information is strictly at your own risk.

2. Not Breeding Advice

SolHerd is not a substitute for the advice and judgement of qualified livestock breeding professionals, geneticists, or breed consultants. Before making any breeding decisions, you should:

• Obtain current, verified EPD data directly from the relevant breed association

Breeding outcomes depend on numerous genetic, environmental, nutritional, and management factors that SolHerd cannot account for. ADappvark accepts no responsibility for any breeding decisions made, or outcomes resulting from, the use of information displayed in the App.

Market data displayed in SolHerd, including cattle prices, auction results, and market trends sourced from USDA, IBGE SIDRA, Eurostat, and World Bank, is provided for general informational purposes only. This data:

• May be delayed, outdated, incomplete, or inaccurate
• Does not reflect real-time market conditions
• Should not be used as the basis for buying, selling, or trading livestock
• Should not be used for financial planning, budgeting, or investment decisions

All data displayed in SolHerd, including but not limited to breed information, EPD values, market data, and herd calculations, may contain errors, inaccuracies, or omissions. Specifically:

• EPD Data: Breed-average EPD values are sourced from publicly published summaries and may not reflect current breed averages. EPD values are updated periodically by breed associations and may change. Individual animal EPDs vary significantly from breed averages.
• Market Data: Sourced from government and institutional databases that may have reporting delays, data revisions, or errors. Prices are indicative only and do not represent offers to buy or sell.
• Breeding Calculator: Calculations are based on simplified genetic models and breed-average data. Actual breeding outcomes are influenced by many factors not captured by the calculator.
• Breed Information: Breed descriptions and characteristics are general summaries and may not reflect the full diversity within a breed or the latest breed developments.

You should independently verify all data before relying on it for any purpose.

7. No Guarantee of Results

ADappvark makes no guarantee, representation, or warranty regarding any results that may be obtained from the use of SolHerd. Past performance, breed averages, and historical market data are not indicative of future results. Livestock performance, market conditions, and breeding outcomes are inherently unpredictable.

8. Blockchain and Digital Asset Risks

SolHerd is distributed via the Solana Seeker dApp Store and uses Sign In With Solana (SIWS) for authentication. While SolHerd does not initiate any blockchain transactions, you should be aware of the general risks associated with blockchain technology, including but not limited to:

• Wallet security risks and the importance of protecting your private keys
• The evolving and uncertain regulatory landscape for blockchain technology
• Technical risks inherent to distributed systems and protocols

ADappvark is not responsible for any losses or damages arising from your use of Solana wallets, blockchain technology, or the dApp Store ecosystem.

9. Third-Party Data Sources

SolHerd aggregates data from third-party sources including USDA, IBGE SIDRA, Eurostat, World Bank, and various breed associations. ADappvark:

• Does not control the accuracy, availability, or timeliness of third-party data
• Is not responsible for errors, omissions, or interruptions in third-party data services
• Does not endorse and is not affiliated with any third-party data provider
• Cannot guarantee continued access to any third-party data source

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADAPPVARK SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

• Loss or death of livestock
• Poor breeding outcomes or genetic defects in progeny
• Financial losses from livestock buying, selling, or trading decisions
• Veterinary expenses or animal health costs
• Loss of profits, revenue, business opportunities, or data
• Indirect, incidental, special, consequential, or punitive damages
• Damages arising from reliance on any data, information, or output of the App

This limitation applies regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, or any other legal theory, and even if ADappvark has been advised of the possibility of such damages.

11. Assumption of Risk

By using SolHerd, you expressly acknowledge and agree that:

• You use the App entirely at your own risk
• You are solely responsible for any decisions made based on information in the App
• You will seek professional advice before making breeding, veterinary, or financial decisions
• You will independently verify all data before relying on it
• You accept all risks associated with the use of the App and its data

12. Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. Nothing in this Disclaimer is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.
