Important: SolHerd is provided for educational and entertainment purposes only. It is not a substitute for professional breeding advice, veterinary guidance, or financial counsel. All information is provided "AS IS" without warranty of any kind.
1. Acceptance of Terms
By downloading, installing, or using SolHerd ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you ("User", "you") and ADappvark ("Developer", "we", "us", "our").
2. Description of Service
SolHerd is a cattle breeding intelligence tool that provides:
- Breed data and Expected Progeny Difference (EPD) reference information
- A breeding pair calculator for educational comparison purposes
- Cattle market data sourced from public government databases
- On-device herd management and record-keeping functionality
The App is distributed exclusively via the Solana Seeker dApp Store and uses Sign In With Solana (SIWS) for identity verification.
3. Educational and Entertainment Use Only
SolHerd is intended solely for educational and entertainment purposes. The App does not provide:
- Professional breeding advice or recommendations
- Veterinary or animal health guidance
- Financial, investment, or trading advice
- Agricultural consulting services
- Guarantees regarding breeding outcomes, animal performance, or market conditions
You acknowledge that any decisions you make based on information displayed in the App are made entirely at your own risk and discretion.
4. No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, AND NON-INFRINGEMENT.
Without limiting the foregoing, we make no warranty or representation that:
- The App will meet your requirements or expectations
- The App will be uninterrupted, timely, secure, or error-free
- Any data, breed information, EPD values, or market data presented will be accurate, current, or complete
- Any results obtained from the use of the App will be accurate or reliable
- Any errors in the App will be corrected
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADAPPVARK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill
- Livestock losses, breeding failures, or poor animal performance
- Financial losses arising from reliance on market data displayed in the App
- Costs of procurement of substitute goods or services
- Any other intangible losses
This limitation applies regardless of the legal theory on which the claim is based, whether arising from contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.
6. Data Accuracy
Breed data, EPD values, and market data displayed in SolHerd are sourced from publicly available information and third-party data providers. We do not independently verify the accuracy of this data. Data may be outdated, incomplete, or contain errors. You should independently verify any information before making decisions based on it.
7. User Responsibilities
You agree to:
- Use the App only for lawful purposes and in accordance with these Terms
- Not use the App in any jurisdiction where its use is prohibited (see Sanctions & Restricted Regions)
- Not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App
- Not attempt to circumvent any security measures or access controls
- Not use the App to engage in any activity that violates applicable laws or regulations
- Not redistribute, resell, or sublicense the App
- Take sole responsibility for any decisions made based on information displayed in the App
8. Sign In With Solana (SIWS)
SolHerd uses the Solana Mobile Wallet Adapter for Sign In With Solana. By using this feature, you acknowledge that:
- SIWS is used for identity verification only
- The App does not initiate, sign, or submit any blockchain transactions on your behalf
- The App does not access your wallet balance, tokens, or transaction history
- You are responsible for the security of your Solana wallet and private keys
9. Intellectual Property
All intellectual property rights in the App, including but not limited to its design, code, graphics, and user interface, are owned by ADappvark or its licensors. See our Copyright Notice and License for further details.
10. Restricted Regions
SolHerd is not available for use in certain sanctioned or restricted jurisdictions. You represent and warrant that you are not located in, and are not a resident or national of, any restricted region. See our Sanctions & Restricted Regions page for the full list.
11. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to warranty disclaimers, limitations of liability, and indemnification obligations.
12. Indemnification
You agree to indemnify, defend, and hold harmless ADappvark and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of the App after any modifications constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, Copyright Notice, License, Disclaimer, and Sanctions policy, constitute the entire agreement between you and ADappvark regarding the use of SolHerd and supersede all prior agreements and understandings.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
