Terms of Service / End-User License Agreement (EULA)

Software: WalkDivine — Catholic Pilgrimage Companion

            Summary: This EULA grants you a personal, limited licence to use WalkDivine for private, non-commercial entertainment. You may not copy, resell, modify, or reverse-engineer it. The app is provided “as is” with no warranty. It is not available in sanctioned regions.
        

1. Acceptance of this Agreement

This End User Licence Agreement (“EULA”) is a legally binding agreement between you (“you”, “the user”) and ADappvark (“we”, “us”, “the Licensor”) governing your use of the WalkDivine mobile application, including all content, updates, and documentation (together, “the Software”).

By downloading, installing, accessing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software. This EULA should be read together with our Terms of Service, Privacy Policy, Disclaimer, and Sanctions & Restricted Regions notice.

2. Grant of Licence

Subject to your continued compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to:

Download and install one (1) copy of the Software on a compatible Solana Seeker or Android device that you own or control; and
Use the Software for your own personal, non-commercial entertainment purposes.

            This licence is granted for personal use only. No commercial use, redistribution, or modification of the Software is permitted under any circumstances.
        

3. Licence Restrictions

You may NOT, under any circumstances:

Redistribute — copy, distribute, publish, share, sell, rent, lease, or sublicense the Software or any portion of it to any third party, whether free of charge or for a fee.
Reverse Engineer — reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, algorithms, or underlying ideas of the Software, except to the limited extent this restriction is prohibited by applicable law.
Modify — modify, adapt, translate, or create derivative works based on the Software.
Commercial Use — use the Software for any commercial purpose, or to build a competing product or service.
Remove Notices — remove, alter, or obscure any copyright, trademark, or proprietary notice in the Software.
Circumvent — bypass, disable, or circumvent any security feature or access control, including sanctions geo-blocking and SGT verification.
Automated Access — use bots, scrapers, or automated means to access or extract data from the Software.

4. Reservation of Rights and Intellectual Property

The Software is licensed to you, not sold. Title to the Software remains at all times with ADappvark. All rights not expressly granted in this EULA are reserved. The Software is protected by Australian and international copyright law. This EULA grants you no rights in any patent, copyright, trade secret, or trademark of ADappvark. 5. Third-Party and Open-Source Components

The Software may incorporate third-party or open-source components licensed under their own terms. Those terms govern your use of the relevant components and, to the extent of any conflict, prevail over this EULA in respect of those components only.

6. Age Requirement

You must be at least 18 years of age to use the Software. By accepting this EULA you confirm that you meet this requirement.

7. Export Control and Sanctions Compliance

You represent and warrant that you are not located in, and are not a national or resident of, any country or region subject to comprehensive sanctions, and that you do not appear on any restricted-party or denied-persons list.

The Software is not available in the sanctioned and restricted regions listed in our Sanctions & Restricted Regions notice, which is incorporated into this EULA by reference and is the authoritative list. The Software applies best-effort geo-blocking; you must not attempt to circumvent it.

8. Wallet Connection (Sign In With Solana)

The Software offers optional identity verification via Sign In With Solana (SIWS). SIWS is a read-only signature request that moves no funds. The Software never accesses, stores, or transmits your private keys or seed phrase, and cannot move funds without your explicit in-wallet approval. You are solely responsible for the security of your wallet. Separately, if you choose to buy a tier unlock, the Software initiates a payment transaction that you approve in your wallet — see Payments below.

8a. Payments and Premium Unlocks

The Software offers optional, one-time tier unlocks (Pilgrim, Wayfarer, Patron) payable in SOL or SKR directly from your own wallet on the Solana blockchain. The Software is fully usable without any purchase. When you buy, the Software builds a payment transaction that you review and approve in your wallet; the transfer goes to the developer’s treasury address. We never take custody of your funds or keys. Network fees apply and are not paid to us. Prices are fixed token amounts, so their fiat value varies. Purchases are one-time digital entitlements delivered on-chain and are non-refundable to the fullest extent permitted by law, and are unavailable in restricted regions.

9. Entertainment Purposes Only

The Software is provided strictly for entertainment and novelty purposes. It is not a navigation tool, travel guide, medical resource, or professional advisory service. You must independently verify all information before relying on it. See our Disclaimer.

10. Termination

This EULA is effective until terminated. Your rights terminate automatically and without notice if you fail to comply with any term. Upon termination you must immediately cease all use of the Software and delete all copies in your possession or control. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and governing law.

11. Disclaimer of Warranties

            THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.
        

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADAPPVARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH your use of or inability to use the Software. In no event shall ADappvark's total aggregate liability exceed the greater of (a) the total amount you have paid, if any, for optional in-app unlocks in the twelve (12) months preceding the claim, or (b) ten Australian dollars (AUD $10.00). The Software itself is free to install; certain optional features may be unlocked by payment.

13. Governing Law

This EULA is governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any proceedings arising out of or relating to this EULA are subject to the exclusive jurisdiction of the courts of Victoria, Australia.

14. Changes to this EULA

We may modify this EULA from time to time. Updated terms will be published on this page and included in future releases of the Software. Your continued use of the Software after an update constitutes acceptance of the revised EULA.
