1. Grant of License
Subject to the terms and conditions of this Proprietary Software License ("License"), ADappvark ("Licensor", "we", "our") hereby grants you ("Licensee", "you") a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to:
- Download and install one (1) copy of WalkDivine ("the Software") on a compatible Solana Seeker device that you own or control.
- Use the Software for your personal, non-commercial purposes in accordance with these terms and the Terms of Service.
This licence is granted for personal use only. No commercial use, redistribution, or modification of the Software is permitted under any circumstances.
2. Restrictions
You may NOT, under any circumstances:
- Redistribute — Copy, distribute, publish, share, or make available the Software or any portion thereof to any third party, whether for free or for a fee.
- Reverse Engineer — Reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, algorithms, data structures, or underlying ideas of the Software.
- Modify — Modify, adapt, translate, alter, or create derivative works based on the Software or any portion thereof.
- Commercial Use — Use the Software for any commercial purpose, including but not limited to selling, licensing, renting, or leasing the Software or any content derived from it.
- Remove Notices — Remove, alter, or obscure any copyright notices, proprietary markings, or attribution notices contained in the Software.
- Circumvent — Bypass, disable, or circumvent any security features, technical protection measures, or access controls built into the Software, including but not limited to sanctions geo-blocking and SGT verification.
- Automated Access — Use bots, scrapers, or any automated means to access, extract data from, or interact with the Software.
3. Intellectual Property
The Software and all copies thereof are proprietary to ADappvark and title thereto remains in ADappvark. All rights in the Software not specifically granted in this License are reserved to ADappvark. The Software is protected by Australian and international copyright laws and treaty provisions.
This License does not grant you any rights to patents, copyrights, trade secrets, trademarks, or any other intellectual property rights of ADappvark. See our Copyright Notice for full intellectual property details.
4. Termination
This License is effective until terminated. Your rights under this License will terminate automatically and without notice if you fail to comply with any term of this License. Upon termination:
- You must immediately cease all use of the Software.
- You must delete and destroy all copies of the Software in your possession or control.
- All provisions of this License that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and governing law.
ADappvark also reserves the right to terminate this License at any time, for any reason, with or without cause.
5. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.
ADappvark does not warrant that:
- The Software will meet your requirements or expectations.
- The Software will be uninterrupted, timely, secure, or error-free.
- The information provided by the Software will be accurate, complete, or current.
- Any errors in the Software will be corrected.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADAPPVARK, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Software.
- Any errors, inaccuracies, or omissions in the Software's content.
- Any personal injury, property damage, or other harm resulting from your use of or reliance on the Software.
- Any unauthorised access to or use of the Software.
In no event shall ADappvark's total aggregate liability to you exceed zero Australian dollars (AUD $0.00), as the Software is provided free of charge.
7. Governing Law
This License shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to this License shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
